Terms of Service

Effective October 18, 2026

These terms govern your use of hillmix.com and the Hill Mix customer portal (the "Services"), operated by Hill Mix ("Hill Mix," "we," "us"). By creating an account, signing in (including with Google) or using the Services, you agree to these terms and our Privacy Policy. If you use the Services for a company, you confirm you are authorized to bind that company, and "you" includes the company.

1. Accounts

• You must be at least 18 and give accurate, current information, including a US cell phone number that can receive texts.
• Keep your password and sign-in methods secure. You are responsible for activity under your account, including by users you invite or give access to.
• Tell us right away at sales@hillmix.com if you suspect unauthorized access.

2. Orders, pricing and invoices

• A pour request, order or drop-off booking made through the Services is a request. It is not accepted until Hill Mix confirms it.
• Prices, load records, tickets and invoices shown in the portal are for convenience. The signed delivery ticket, your written quote or price agreement, your approved credit terms and the invoice control if they differ from what the portal shows.
• Delivery, materials, payment terms, cancellations, waiting time and returned concrete are governed by your quote, credit agreement, delivery tickets and invoices.

3. Text messages

By giving us your cell number you agree to receive texts with verification codes and updates about your loads and account. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.

4. Acceptable use

You will not: access accounts or data that are not yours; share your sign-in; interfere with, probe or overload the Services; scrape or copy the Services by automated means; or use the Services for anything unlawful.

5. Our content

The Services, including the Hill Mix name, logo, site design and content, belong to Hill Mix. You may use them only to do business with Hill Mix.

6. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent allowed by law, Hill Mix disclaims all warranties for the Services, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and does not promise the Services will be uninterrupted or error-free. Figures marked typical on the site are design targets, not audited results. Warranties for materials, if any, are only those in your quote, ticket or invoice.

7. Limitation of liability

To the fullest extent allowed by law, Hill Mix will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data, arising from your use of the Services. Hill Mix's total liability for any claim arising from the Services is limited to one hundred dollars ($100). This section does not limit obligations under your quotes, credit agreements, tickets or invoices.

8. Indemnity

You will defend and indemnify Hill Mix against claims and costs arising from your misuse of the Services or breach of these terms.

9. Suspension and termination

We may suspend or close access to the Services for breach of these terms, a past-due account, or to protect the Services or other users. You may close your account at any time by contacting us. Amounts owed survive termination.

10. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue for any dispute lies in the state or federal courts serving Denton County, Texas.

11. Changes

We may update these terms by posting a new version here with a new effective date. Continued use after an update means you accept it.
